Commercial Vehicle Accidents

Anything that is owned by a company is considered a commercial vehicle. This can include more obvious vehicles like tractor trailers and bix box trucks. A commercial vehicle can also be anything from a pickup truck from an oil company, to a mom-and-pop shop that has somebody driving a car. As long as they’re in the course and scope of business, it’s considered a commercial accident.

There are hundreds of tractor trailers and commercial drivers on the roads. Every year in texas there are thousands of serious crashes and fatalities. There were over 1,600 fatalities just last year alone in the state of Texas.

When someone hires a driver to operate one of their vehicles, they have an obligation to do background and driving history checks, to ensure that they’re not under the influence of drugs, or any other potential risk factors. When someone is involved in a serious collision with a truck or tractor trailer, we have to act immediately. You need somebody who will meticulously investigate all the facts about that person who caused the accident, what they were doing at the time, and who they were working for.

The trucking industry is heavily regulated and the businesses that have commercial drivers are subject to a laundry list of laws and it takes an expert— someone who is familiar with the industry— to be able to adequately represent a victim of a trucking crash or commercial vehicle accident. John Escamilla is that expert.

We’re not a high volume law firm, we give every case special attention.``

Workplace Accidents

Everybody is entitled to a safe workplace. There’s a common saying in the realm of workplace safety: “every accident is preventable,” and we believe that. The Occupational Safety and Health Administration (OSHA) regulates the workplace to ensure this, and employers are to comply to these standards, especially when requiring people to use heavy equipment and machinery on the job. Many times, too often, the employers don’t provide a safe place or safe equipment.

John Escamilla has handled hundreds of cases involving people who have been seriously injured and even killed at work. When someone is hurt on the job, we look into all the circumstances as to why and how they got injured. We find out:

    • What equipment they were using
    • What training they have received
    • Who was supervising them
    • What were they asked to do
    • How many hours they had been working

All of these factors can contribute to finding the root cause of the accident. Too often the victim is falsely blamed. After investigating, we find that it is usually the employer to blame because of lack of compliance to the safety guidelines they are legally required to uphold.

Our clients expect results and we have the confidence to deliver. As a client of Steinberg Injury Lawyers, you will not only receive highly-skilled legal representation, you will also be given first-class treatment. Further, numerous law firms, many of them accident law firms, refer their injured clients to us because of our reputation. Our goal is to do everything for you, so you can focus on your recovery.

Personal Injury

Whether you have been injured in a car accident or a slip & fall case, we take every case seriously. You’re not just a statistic. We are not a high volume business—every case we get, we give individualized attention to. when somebody is injured in a crash, we’ll help you get set up with medical providers to get the medical care that you need. We will make sure that the people that are potentially responsible are put on notice, that the evidence is preserved, and then we litigate the cases aggressively. You can rest assured that if you have a case that is coming to escamilla law firm, you’re going to have a lawyer working on your case. That’s a guarantee.

Dram Shop Cases

Dram shop litigation is also known as liquor liability or alcohol liability. Every store, restaurant or bar that serves alcohol is regulated by the Texas Alcoholic Beverage Commission (TABC), and they have an obligation not to sell alcohol to someone who is visibly intoxicated. Unfortunately we know that this happens all too often. Whenever there is a business that serves alcohol to someone who is visibly intoxicated, they drive from that location, and they hurt themselves or someone else, we will go after that bar or restaurant and hold them accountable.

Slip/Trip & Fall / Premises Liability

Whenever you go to a business that is open to the public, they have a responsibility to make sure that their facility is reasonably safe. That can mean cleaning up floor spills, making sure there aren’t trip hazards or any other obstacles that can injure people. John Escamilla has seen many cases in which people have been seriously injured—broken their knees, torn ligaments, hurt their back— due to dangerous conditions on business premises. Because you’re invited to that business, you, as the customer, should be able to rely on the safety of that premises.

When somebody is injured at a place of business, we will go out there, investigate, take photos, and we will sue that business and get that recovery that our clients are entitled to, based on the dangerous condition. We hold those businesses accountable for making sure that they keep the premises in good condition.

Product Liability

Products—from medical devices, automobiles, and work equipment, to personal consumer goods—can be dangerous. They can be a result of a bad design, they can be manufactured incorrectly, there could have been mistakes in the manufacturing, or they could also be dangerous because they don’t warn the consumer about how to use them safely.

John Escamilla has filed many lawsuits involving dangerous cars, defective tires that cause serious collisions, medical devices, saws, and other things that people use in everyday life. If there is a product that is unreasonably dangerous, we will hire engineers and industry experts to tell us whether or not that product should have been designed or manufactured differently, or whether there should have been specific warnings on how to use it.

In regard to dangerous products, there are different things that we can hold product manufacturers accountable for under the law but it takes litigation, and takes hitting them in the bank for them to make those changes—permanent changes that will prevent future accidents.

Vehicles today are safer than they were 20 years ago and that’s the result of lawyers like John Escamilla who file lawsuits against them for having dangerous products. Now we have things like electronic stability control, seatbelt pretensioners, airbags, which that didn’t use to be on vehicles, but because we held the manufacturers accountable for not having them, they started integrating them into their products as a new safety standard.

Unfortunately, manufacturers don’t always do what they need to do and they cut corners on parts and materials sometimes and as a result, the consumer pays the price. Escamilla Law Firm PLLC  holds them accountable for that.

When somebody is injured at a place of business, we will go out there, investigate, take photos, and we will sue that business and get that recovery that our clients are entitled to, based on the dangerous condition. We hold those businesses accountable for making sure that they keep the premises in good condition.
